NOTA PRAWNA I REGULAMIN STRONY

LEGAL NOTICE & TERMS OF USE

§ 1. Postanowienia ogólne
    1. Niniejsza nota prawna określa warunki korzystania z witryny internetowej LABAZONA.art (zwanej dalej „Stroną”).
    2. Właścicielem Strony oraz jedynym autorem wszelkich prezentowanych na niej treści jest Aldona Słupińska (zwana dalej „Autorką”).
    3. Kontakt z Autorką jest możliwy za pośrednictwem formularza kontaktowego lub danych wskazanych na Stronie.

§ 2. Ochrona Praw Autorskich (Własność Intelektualna)
    1. Wszystkie materiały opublikowane na Stronie – w tym wiersze, teksty literackie, kompozycje muzyczne, nagrania audio (w tym utwory typu spoken word), materiały wideo, grafiki, zdjęcia, układ graficzny oraz kod źródłowy – stanowią utwory w rozumieniu Ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych.
    2. Autorce przysługują wyłączne osobiste i majątkowe prawa autorskie do wszystkich wyżej wymienionych materiałów.
    3. Projekt LABAZONA.art jako cała witryna stanowi integralne, transmedialne dzieło cyfrowe i podlega pełnej ochronie prawnej.

§ 3. Warunki korzystania z materiałów
    1. Użytkownik ma prawo do przeglądania Strony, czytania tekstów oraz odsłuchiwania materiałów audio/wideo wyłącznie w ramach osobistego użytku osobistego (niekomercyjnego).
    2. Kopiowanie, zwielokrotnianie, rozpowszechnianie, pobieranie plików audio i wideo, publiczne odtwarzanie lub wykorzystywanie jakichkolwiek materiałów ze Strony do celów komercyjnych bez uprzedniej, pisemnej zgody Autorki jest surowo zabronione.
    3. Wykorzystanie poezji lub muzyki Autorki do tworzenia dzieł zależnych (miksów, remiksów, antologii, adaptacji) wymaga osobnej licencji.

§ 4. Zakaz trenowania systemów Sztucznej Inteligencji (AI)
    1. Autorka wyraźnie zastrzega, że nie wyraża zgody na cyfrowe przeszukiwanie danych (Text and Data Mining – TDM) na Stronie w rozumieniu art. 4 ust. 3 Dyrektywy (UE) 2019/790 (Dyrektywa DSM).
    2. Wykorzystywanie tekstów, muzyki, głosu oraz grafik ze Strony do trenowania modeli językowych (LLM), generatorów muzycznych oraz jakichkolwiek innych systemów Sztucznej Inteligencji (AI) bez pisemnej umowy jest nielegalne.
 
§ 1. General Provisions
    1. This Legal Notice defines the terms of use for the website LABAZONA.art (hereinafter referred to as the „Website”).
    2. The owner of the Website and the sole creator of all content presented herein is Aldona Słupińska (hereinafter referred to as the „Author”).

§ 2. Copyright Protection (Intellectual Property)
    1. All materials published on the Website – including poems, literary texts, musical compositions, audio recordings (including spoken word pieces), video materials, graphics, photographs, layout, and source code – are works protected under copyright law.
    2. The Author holds exclusive moral and economic copyrights to all the aforementioned materials.
    3. The LABAZONA.art project as a whole constitutes an integral, transmedia digital artwork and is subject to full legal protection.

§ 3. Terms of Use for Materials
    1. Users are permitted to browse the Website, read texts, and listen to audio/video materials solely for personal, non-commercial use.
    2. Copying, reproducing, distributing, downloading audio and video files, publicly performing, or using any materials from the Website for commercial purposes without the prior written consent of the Author is strictly prohibited.
    3. Any use of the Author’s poetry or music to create derivative works requires a separate license.

§ 4. Restriction on Artificial Intelligence (AI) Training
    1. The Author explicitly states that she does not consent to text and data mining (TDM) on the Website in accordance with Article 4(3) of Directive (EU) 2019/790 (DSM Directive).
    2. Utilizing texts, music, voice, or graphics from this Website for training large language models (LLMs), music generators, or any other Artificial Intelligence (AI) systems without a written agreement is strictly prohibited.
